Mandatory Counseling and Waiting Period

Maryland does not require mandatory counseling or impose a waiting period before an abortion procedure.

Parental Notification Requirement for Minors

If you are under 18, Maryland law mandates that one parent or guardian be notified before an abortion is performed. However, the parent or guardian's consent is not required. In certain situations, such as cases of abuse or if notification is deemed not in the minor's best interest, this requirement can be waived by the physician. 

Gestational Limits

Abortion in Maryland is legal up to the point of fetal viability, generally considered to be around 24 to 26 weeks of pregnancy. After this point, abortions are permitted only if:

  • The procedure is necessary to save the pregnant person's life.

  • Continuing the pregnancy would pose a serious risk to the pregnant person's physical health

Legal Protections

In 2024, Maryland voters approved an amendment to the state constitution, enshrining the right to reproductive freedom, including abortion access. This ensures that abortion remains legal in Maryland, even if federal protections change.
