Your Rights as a Survivor


Survivors of sexual assault have legal protections under state and federal laws. These rights ensure that you can access medical care, control what happens to your forensic evidence, and seek justice if you choose. While specific laws vary by state, here are some fundamental rights:

Medical & Forensic Rights

✅ The Right to a Forensic Exam Without Reporting to Police:

  • In many states, you can receive a Sexual Assault Forensic Exam (SAFE) or rape kit without being required to speak to law enforcement. The evidence will be stored for a period (often 6 months to several years) in case you decide to report later.

✅ The Right to a Medical Exam & Treatment

  • You have the right to be treated for injuries, STIs, pregnancy prevention (such as emergency contraception), and emotional trauma without police involvement.

✅ The Right to Confidentiality

  • Your medical and forensic exam records cannot be released without your written consent (except in cases involving minors or mandatory reporting laws).

✅ The Right to an Advocate or Support Person

  • Many states allow survivors to have a trained sexual assault advocate, friend, or family member present during forensic exams and police interviews.

✅ The Right to Be Treated with Dignity & Respect

  • You have the right to compassionate and trauma-informed care, free from judgment or coercion.
